Terms and Conditions for Layovers.Amsterdam


Layovers.Amsterdam is a trade name of Dutch Flower Tours, registered with the Chamber of Commerce in Amsterdam (KvK number: 73130222).


Please read these terms and conditions carefully before making a reservation. They outline your rights and obligations and will be referred to in case of any disputes. These terms and conditions apply to all users and customers of Layovers.Amsterdam.


1. Important Information

These Terms and Conditions do not affect your mandatory legal rights under applicable laws, including statutory rights or local legislation such as the EC Travel Directive (90/314/EEC). For instance, UK citizens enjoy additional protections under the Package Travel, Package Holidays, and Package Tours Regulations 1992.


2. Definitions

  • Group Leader: The person completing the online reservation form.
  • You: Includes the Group Leader and all members of the Group.
  • Group: All individuals to whom the travel arrangements apply, including anyone added or substituted after the booking has been made.


3. The Contract

By making a reservation or agreeing to a quote, you are entering into a contract with Dutch Flower Tours on the following terms.


3.1 Governing Law

This contract is governed by the laws of the Netherlands, and disputes will be resolved in the courts of the Netherlands unless otherwise required by mandatory consumer protection laws.


3.2 Applicability

The terms apply to all bookings confirmed by Dutch Flower Tours after September 1, 2018.


3.3 Age Restrictions

For tours involving alcohol, all participants must be at least 18 years old. Proof of age may be requested.


3.4 Acknowledgment

Participants must acknowledge and agree to the terms by signing a holiday voucher or confirming online during the booking process.


3.5 Severability

If any term is deemed invalid, illegal, or unenforceable, the remaining terms remain unaffected.


3.6 Third-Party Rights

No third party shall benefit from or enforce any provision of these terms.


4. Booking Procedure


4.1 Request and Quote

Booking requests can be made via email or the website. Dutch Flower Tours will provide a detailed quote, excluding costs for refreshments, events, transfers, or additional services unless explicitly stated.


4.2 Confirmation

Your booking is confirmed only when Dutch Flower Tours issues an invoice via email. Acceptance of the booking is at Dutch Flower Tours's discretion.


4.3 Payment Terms

  • 50% of the total amount must be paid within seven days of receiving the invoice.
  • The remaining 50% must be paid no later than seven days before arrival.


5. Variations



5.1 Changes by Dutch Flower Tours

Dutch Flower Tours reserves the right to:

  • Modify terms before full payment.
  • Adjust activities, services, or prices as necessary before arrival.
  • Deduct the remaining balance for cancellations within seven days prior to the event.


5.2 Changes by You

To request changes after booking, the Group Leader must email Dutch Flower Tours. Any alterations may incur additional costs based on current rates.


5.3 Currency Fluctuations

Payments in currencies other than euros may incur surcharges due to exchange rate fluctuations. Customers will be notified of significant increases.


6. Cancellations


6.1 By Dutch Flower Tours

If activities cannot proceed due to unforeseen circumstances (e.g., weather, supplier issues), affected services will be refunded.


6.2 By You

Cancellations must be confirmed by email. Fees apply as follows:

  • No charge before the holiday voucher email is issued.
  • 25% charge after the voucher is issued.
  • 100% charge for cancellations within seven days of arrival or post-arrival no-shows.


7. Obligations and Liabilities


7.1 Dutch Flower Tours

  • Acts as a booking agent for accommodations and activities.
  • Ensures reasonable standards and compliance with health and safety laws.


7.2 Your Responsibilities

  • Conduct yourself responsibly and follow instructions from representatives.
  • Arrive on time for scheduled activities (late arrivals may result in cancellations).
  • Ensure valid travel documents and insurance.


8. Liability Limits

Dutch Flower Tours is not liable for:

  • Issues caused by customer actions, third parties, or force majeure events.
  • Discrepancies in accommodation ratings or activity descriptions.
  • Services purchased outside the original booking.

Compensation, where applicable, will be limited to the total booking cost.


9. Complaints Procedure

  • Complaints must be reported immediately to suppliers and representatives.
  • Unresolved complaints must be emailed to Dutch Flower Tours within 28 days of your return.


10. Photo and Video Use

Photographs or videos may be taken for promotional purposes. Consent will be sought beforehand. To opt out, email hello@dutchflowertours.com.
